DMCA & Copyright Policy

At Pagenflow ("we," "us," or "our"), we respect the intellectual property rights of others and expect our users to do the same. It is our policy, in appropriate circumstances and at our discretion, to disable or terminate the accounts of users who infringe the intellectual property rights of others.
This policy applies to our email builder service at www.pagenflow.com (the "Service").
1. Reporting Claims of Copyright Infringement
If you believe that any material available on or through the Service infringes your copyright, you may submit a written notification of claimed infringement under the Digital Millennium Copyright Act (DMCA). Your notice must include the following information as required by 17 U.S.C. § 512(c)(3):

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.

Identification of the material that is claimed to be infringing or to be the subject of infringing activity, along with information reasonably sufficient to permit us to locate the material (e.g., the URL of the email template or user content).

Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an email address.

A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Important Note: Under the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages (including costs and attorneys' fees).
2. Counter-Notification Procedures
If you believe that material you posted on the Service was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification. Your counter-notification must be a written communication that includes the following:

Your physical or electronic signature.

Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.

A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the federal courts located in Cameroon if your address is outside of the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

After receiving a valid counter-notification, we will forward a copy to the original complaining party. If we do not receive notice within 10 business days that the original complainant has filed an action seeking a court order to restrain you from engaging in infringing activity, we may restore the removed material.
3. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, Pagenflow has adopted a policy of, in appropriate circumstances and at our sole discretion, terminating the accounts of users who are determined to be repeat infringers. A "repeat infringer" includes any user who has been notified of infringing activity more than twice or whose content has been removed from the Service more than twice.
4. Template Ownership & User Responsibility
As stated in our Terms of Service (Section 3), Pagenflow is an email template builder tool.
- You retain full ownership of all email templates and designs you create using our Service.
- You are solely responsible for ensuring that any content you create (including text, images, designs, and code) does not infringe upon the intellectual property rights of any third party.
- Using our Service to create a template that copies or is substantially similar to a copyrighted design owned by another person or entity is a violation of this policy and our Terms of Service.
5. False Claims
Please be aware that under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be held liable for damages (including costs and attorneys' fees).
6. Modifications to This Policy
We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to this page, and we will update the "Last Updated" date accordingly. Your continued use of the Service after any such changes constitutes your acceptance of the new policy.
